Our
Firm's Toxic Tort practice consists of several decades of collective experience
in successfully defending various employers, product manufacturers, contractors
and premises owners in lawsuits alleging personal injury, wrongful death
or property damage because of exposure to various alleged toxins. This
experience includes:
• Successfully trying cases to verdict in all areas of Texas.
• Assisting newly sued defendants such as home builders, communications
companies and other "new-wave" defendants in investigating claims
and facts, developing defenses and both case-specific and overall cost-effective
litigation strategies to achieve expedient extrication from the litigation.
• Regional counsel overseeing the defense and administration of
thousands of claims, including developing and maintaining litigation and
settlement budgets, negotiation of large-scale, innovative case resolution
agreements, and supervising numerous local and trial counsel on specific
cases.
• Developing methods for resolving litigation problems using innovative
non-litigation techniques, including developing favorable case management
protocol adopted by courts, streamlining discovery efforts by developing
joint discovery plans for using common experts, and other cost-effective
discovery tactics.
• Effectively shaping the litigation process through our judicial
and legislative contacts and relationships, including involvement in tort
reform legislative committees and other measures.
• Successfully using the appellate system reversing or mitigating
negative results.
